These Terms of Service ("Terms") govern your access to and use of the Swander mobile application and related online features offered by us (the "Service"). The operator of Swander ("we," "us," or "our") provides the Service subject to these Terms.
By downloading, installing, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Use of the software itself may also be subject to our End User License Agreement presented in or with the app. If there is a conflict between these Terms and the EULA purely regarding licensing of the app executable, the EULA controls as to that narrow topic; otherwise these Terms control regarding conduct, accounts, and content on the Service.
The Service is intended only for individuals who are at least eighteen (18) years old. By using the Service, you represent and warrant that you meet this age requirement and have legal authority to agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization and references to "you" include that organization.
Swander helps you discover and share walking or travel-related routes, participate in route exchanges with other users where that functionality is offered, browse and interact in community areas such as Gather, maintain a profile, and use related tools such as exploring routes, walking or completing route experiences, notifications, and saved content. Features may vary by platform version and region.
Optional in-app progress, achievements, or similar engagement mechanics may exist from time to time. Any rules displayed inside the app govern how those mechanics operate. Nothing in these Terms creates an entitlement to any particular outcome beyond what the app expressly provides.
We may modify, suspend, or discontinue any part of the Service, including features, with or without notice where permitted by law. We are not liable for any inability to access the Service or for changes that affect how you use it, except where mandatory law says otherwise.
You may need an account. You are responsible for safeguarding credentials you control and for activity under your account. You must provide accurate information and update it when it changes. Notify us promptly at the contact email if you suspect unauthorized access.
You retain ownership of content you submit ("Your Content"), subject to the licenses below. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt as needed for technical operation, display, perform, and distribute Your Content as reasonably necessary to operate, secure, improve, and promote the Service, including showing it to other users according to feature behavior you choose.
You grant other users the rights implied by the interactions you enable (for example viewing a route or comment you make available).
You represent that you have all rights needed to grant these licenses and that Your Content does not violate law or third-party rights. We may remove or restrict Your Content that we reasonably believe violates these Terms, our policies, law, or others' rights, or creates risk to safety or the Service.

The Service offers optional paid features, including a VIP membership subscription and virtual currency ("Swander Coins"), purchasable through the Apple App Store (or any other official app store through which the app is distributed). All transactions are processed by the applicable store operator under its own terms; we do not collect or store payment card or billing information.
VIP membership is an auto-renewing subscription that unlocks additional benefits within the Service (such as bonus Explore draws per period, avatar frame styles, and custom profile backgrounds) for the duration of your active subscription. The following terms apply:
Swander Coins are a virtual in-app currency that you may purchase in packs and use within the Service for certain features (such as paid Explore draws, unlocking route details, or other interactions described in the app). The following terms apply:
You may restore a VIP subscription that is active under the same store account on a new device by using the "Restore Purchases" function in the app. Consumable items (Swander Coins) cannot be restored after they have been used or after their associated transactions have been completed, as they are single-use items under App Store rules.
All billing and payment disputes related to in-app purchases must be raised directly with the applicable app store (e.g., Apple). We are not able to process refunds or adjust charges on behalf of the store. Contact us at the support email if you have questions about what a purchase provides within the Service itself.
Routes and place descriptions shown in Swander are provided for general inspiration and planning. They appear as text, media, and structured steps contributed by users or presented as curated content; the Service does not verify where you are using device-based positioning in the version covered by these Terms. Conditions on the ground change; terrain, weather, regulations, and hazards vary. You are solely responsible for evaluating whether an activity is safe and lawful for you. We do not guarantee accuracy, completeness, or suitability of any route or place information. Always follow local laws, land-use rules, signage, and common sense.
Except for Your Content and third-party materials, the Service including software, branding, layout, and documentation is owned by us or our licensors and protected by intellectual property laws. Except for the limited rights explicitly granted in these Terms and the EULA, no rights are granted. Do not use our trademarks or branding except as allowed by law or with our written consent.
The Service may integrate third-party services such as account sign-in providers, analytics, crash reporting, hosting, payment processing via app stores, or similar infrastructure. Your device's operating system may also prompt for access to your photo library or camera when you add images, or for notifications, depending on features you use. Your use of those services and system prompts is governed by their respective terms and privacy policies where applicable. We are not responsible for third-party services beyond our reasonable integration choices.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. NOTHING IN THIS SECTION REDUCES LIABILITY THAT CANNOT BE LIMITED UNDER MANDATORY LAW.
Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the fullest extent permitted.
You will indemnify and hold harmless us and our affiliates, officers, directors, employees, and agents from claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your breach of these Terms, except to the extent caused by our willful misconduct.
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, create risk or legal exposure for us or others, or for operational reasons. When enforceable, termination does not remove provisions that should survive, including intellectual property, disclaimers, limitations, indemnity, and governing law. Termination or suspension of your account does not entitle you to a refund of any purchased Swander Coins or remaining subscription periods, except as required by mandatory applicable law.
These Terms are governed by the laws of your country of residence, excluding conflict-of-law rules that would apply another jurisdiction's laws, except that mandatory consumer protections where you live remain unaffected. Courts located in your country of residence have non-exclusive jurisdiction unless mandatory law requires otherwise.
These Terms are the entire agreement between you and us regarding the Service and supersede prior understandings on this subject. If a provision is invalid, the remainder remains enforceable. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices may be provided through the Service or by email.
If you submit suggestions, ideas, or other feedback about the Service, you grant us a perpetual, worldwide, non-exclusive, royalty-free license to use that feedback for any purpose related to operating and improving the Service, without obligation to you, except where mandatory law prohibits that grant.
